Terms & Conditions The TaxChopper Online software is provided by CuteTax Inc. Access to and use of this software is subject to the following terms and conditions. By clicking "I agree" below you signify your unconditional acceptance of these terms and conditions of use. If you don't agree to these terms & conditions, you can click "I don't agree" to leave this page. As used in this Agreement, the terms "you", "user" and "client" are synonymous, and refer to the person using the Services in any way. "CuteTax", "we" refer to CuteTax Inc. You are solely responsible for evaluating the accuracy and completeness of the information you enter. The help page in this site is intended for general information only and should not be construed as advice under the Income Tax Act. You are advised to take appropriate professional advice if you are not sure how to enter your tax items. You agree to review your tax return for indications of obvious errors prior to electronically filing or printing your and your family members' returns. You are also responsible for acquiring and maintaining all equipment, computers, software and communications services (such as long distance phone charges) relating to the access and use of the Services, and for all expenses relating thereto (plus applicable taxes). The payment of all fees and charges to CuteTax Inc., if applicable, must be made by your valid credit card and, except as otherwise provided herein, all fees and charges are non-refundable. CuteTax currently expects to make the Services available all year around. However, CuteTax Inc. has the right at any time and for any reason to modify or discontinue any aspect or feature of the Services, including but not limited to its content, functionality or hours of availability, the equipment needed for its access or use. CuteTax is not responsible for the late filing of your tax return due to such discontinuation of Services, and you acknowledge that you should file your tax return as early as possible to meet any filing deadlines. Limited Warranty for Registered Users You are responsible to report all tax situations of you and your family members who need to prepare a return using the software, include but not limited to: income, expenses, deductions or previous years deductions(if they apply, for example, capital gain deductions). You are responsible for the completeness and accuracy of the data; if someone is claimed as a dependant or spouse by you or by your family member in the Tax Chopper-generated return but whose return is not generated by the software, his/her net income must be reported correctly. CuteTax warrants the calculations based on the data you enter are correct. Disclaimer Except as expressly provided above, CuteTax disclaims all other warranties, express or implied, regarding the services and related materials, including their fitness for a particular purpose, the quality, their merchantability, or their non-infringement. CuteTax does not warrant that the service is free of bugs, interruptions, errors, or other program limitations. CuteTax does not warrant that this site is free of viruse or other harmful components. Except to the extent of the limited warranty (of calculation accuracy) described above, the entire liability of CuteTax for any reason shall be limited to the amount paid by you for the Services licensed from CuteTax. To the maximum extent permitted by applicable law, CuteTax is not liable for any indirect, special, incidental, or consequential damages (including damages for loss of business, loss of profits or investment, or the like), whether based on breach of contract, breach of warranty, tort (including negligence), product liability or otherwise, even if CuteTax has been advised of the possibility of such damages and even if a remedy set forth herein is found to have failed of its essential purpose. Security CuteTax is committed to delivering secure service to our clients. We employ 128 bits secure socket layer to transmit your data between you browser and our server. 128 bits SSL is currently used by banks and other financial institutes. A firewall is established around the servers. Privacy policy We collect your personal information only for the purpose of preparing your tax return. We will not sell or disclose any of your information to any third party. When you register an account, you can elect to use an email address or any specified plain name as a login name. You can change it at any time. If you use your email address, we only send our new tax product information once in the next tax year. We will not disclose your email address to any party. When you make a payment with your credit card, your credit card information (i.e. number, expiration date and postal code) only goes through our system toward the financial institute one time. We do not keep any of this information. We acknowledge to you that it is quite reasonable that the financial institute will keep all transaction records for a period of time. CuteTax is not responsible for the content, accuracy or availability of the information provided on a third party site.
